Application of these Terms of Use

netballplayersassociation.com (Site) is owned and operated by Netball Players Association (NPA, we, our, us).

The NPA provides the Site as a venue for people to access information relating to the NPA and their membership of the association.

The use of this Site is governed by these terms and conditions and the privacy policy. Please read the Terms of Use carefully. Your use of this Site indicates your acceptance of the Terms of Use.

You (User, you, your) indicate your acceptance of these Terms of Use by accessing, using and/or placing an order for Products using the Site.

These Terms of Use shall replace any subsequent terms or conditions.

Variation of these Terms of Use

The NPA may make changes to this Site and these Terms of Use at any time. If we change these Terms of Use we will publish an updated version under the ‘Terms’ link on the Site. Your access or use of the Site after an updated version of these Terms of Use has been made available on the Site indicates your acceptance of the updated Terms of Use.

No Illegal Use

You must not use the Site in any manner or for any purpose which is illegal.

All materials displayed on the Site, including without limitation, all text, graphics, advertisements, names, logos, trade marks, applications and software (whether registered or not) (Our Content) are our property or the property of their respective owners (including our licensors and other Users) and are protected by copyright, trade mark and other intellectual property laws.

You may use Our Content for your personal, non-commercial purposes, such as to obtain information about membership using this Site. Except where the law expressly allows, you may not use, reproduce, modify, distribute, post, transmit, distribute, publish or create derivative works from, or use for any commercial purpose, any part of Our Content.

To the extent allowed by law, the NPA does not guarantee the accuracy, completeness, security or currency of Our Content or User Content and we have no liability to you for your use or reliance on Our Content or User Content.

Any unauthorised use of the materials appearing on this Site may violate copyright, trade mark and other applicable laws and could result in criminal or civil penalties.

The NPA reserves all other rights not expressly granted.

Access to Linked Sites is provided for convenience only and you are responsible for deciding whether you want to use a Linked Site. You access these sites and use or buy their products and services solely at your own risk.

The NPA does not control or endorse and are not responsible for any features, content, Products or other materials on or available from a Linked Site. Any rights, claims or actions you may have in respect of a Linked Site can only be brought directly against the owners or operators of the Linked Site.

The NPA may receive payments and/or commissions from owners or operators of Linked Sites and you will not have any claims, benefits or rights on these payments.

Liability and Indemnity

To the extent permitted by law, the NPA and its directors, officers, employees, agents and contractors exclude all liability to you in connection with the Site. You indemnify and hold us harmless for any and all claims, loss or damage however arising, (whether in negligence or otherwise) in connection with:

(a) your failure to comply with these Terms of Use;

(b) your use, misuse of reliance on the Site, Our Content, User Content or Linked Sites;

(c) your Content, including its use, misuse or misappropriation; or

(d) any other acts or omissions by you.

Consumers have certain rights under English Consumer Law and similar state and territory legislation (ACL). Nothing in these Terms of Use excludes any rights you have under the ACL in respect of the Site. Subject to the previous sentence, you acknowledge that your use of the Site, Our Content, Your Content, User Content and Linked Sites, is entirely at your own risk and are provided without warranty, either express or implied.

We do not accept responsibility for any interference, loss or damage to your data, computer system, or mobile device which arises in connection with your use of the Site. Although reasonable precautions have been taken, we do not guarantee that access to the Site will be uninterrupted, or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted on the Site.

You may be asked to input information about yourself on different areas of the Site. If so, we will only use that information in accordance with our Privacy Policy.

We may terminate your access to the Site (or any part of it) at any time without reason and without notice. These Terms of Use survive any such termination.

Force Majeure

The NPA will not be liable for any delay in performing any of its obligations if the delay is caused by circumstances beyond its reasonable control, such as failure of or interruption in the provision of essential services such as electricity supply or bank payment systems.

Transfer and Assignment

If the NPA merges with, sells to or otherwise changes control of its business or the Site, we may, without giving you notice or seeking your consent, transfer or assign to a third party, personal information, content and rights that the NPA has collected from you and any agreements it had made with you in connection with your use of the Site in accordance with the GDPR Regulation effective May 2018.

Severability

If any part of these terms is found to be void, invalid, unlawful or unenforceable, then that part will be severed from these terms and the remaining terms will remain in force and comprise the agreement between you and the NPA.

Waiver

The failure by the NPA to exercise or enforce any right or provision under these terms will not constitute a waiver of the right or provision. Any waiver of any provision under these terms will only be effective if it is in writing and signed by the NPA.

Jurisdiction

These Terms of Use are governed by the laws in force in United Kingdom and you submit to the non-exclusive jurisdiction of the courts in that place.

If you access this Site in a jurisdiction other than the UK, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply. The NPA makes no representations that the content of the Site complies with the laws of any country outside the UK.

Errors

We may correct any errors which appear on the Site and reject any Orders which have been received in connection with such errors.

Price

Prices displayed on the Site are shown in British Pounds and include VAT, where applicable. Prices are subject to change at any time.

​

Delivery costs will be charged in addition to the price of the Products.

​

Unless otherwise stated, any accessories shown in any image of Products are not included in the price.

​

Change of Address

The NPA cannot be held responsible for an incorrect address being entered on your membership. If you complete your membership and then notice that the address details are incorrect, please contact the NPA immediately.

Payment

You must pay the NPA for the Products at the time of placing your Order using the Site. The NPA accepts Visa, MasterCard and PayPal. You must comply with the terms and conditions of these providers.

​

If you elect to pay by Visa, MasterCard or Maestro, charging or debiting of your payment card will only be made when you elect to pay for the items you have ordered at the end of the check-out. Prior to this step, your Order will not be recorded or processed.

​

Upon receiving your Order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. If the issuer of your payment card refuses to, or does not authorise payment for any reason, then you will be notified of this immediately prior to completing your purchase using the Site at the check-out stage. Your card will be debited once the Order has been accepted.

Overseas Membership

We do not convert the total price of memberships into other currencies. We will bill your credit or debit card or PayPal account in British Pounds and the card company or PayPal will convert the charges for you. If you have any questions about currency conversions please contact your bank or financial institution.

The actual price charged to overseas customers will be subject to the exchange rate applied by the customer’s credit or debit card company.

Discount Codes.

​

Promotional discount codes may be offered from time to time on certain membership levels. These discount codes will be available for a limited amount of time only and of a limited usage.

​

The entire amount of any discount code must be used in one single transaction. Refunds will not be given for any leftover value. Discount codes do not cover the cost of shipping.

​

Security

Your credit card details are not stored by the Site, they are passed securely through PayPal’s online payment gateway. All supplied sensitive credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Database.

When placing a membership order, you undertake that you are an authorised user of the credit or debit cars used to place your membership order. If you are not the cardholder listed on the credit card, do not make a purchase using the Site. The NPA will report any instances of credit card fraud to the British Police and banking authorities.

In assessing your request for goods or services, we may use your information for the purposes of the prevention and detection of fraud.

​

Limitation of Liability

To the extent not prohibited by law, in no event shall the NPA be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the membership and associated products, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if the NPA has been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall the NPS’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount you have actually paid to the NPA for the associated products. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

What information do we collect?

We collect information from you when you register on our site, subscribe to our newsletter or upload photos. When ordering on our site, you may be asked to enter your name, e-mail address, date of birth, mailing address or phone number.

We may collect and use non-personal information such as the identity of your Internet browser, the type of operating system you use, your IP address and the domain name of your Internet service provider to optimise our goods and services to you.

 

What do we use your information for?

We use your Personal Information to provide you with information, process your orders and for any related or ancillary purposes, including, without limitation:

We will keep all Personal Information we receive from you confidential. We implement a variety of physical and electronic security measures to maintain the safety of your Personal Information.

We restrict physical access to our offices and offer the use of a secure server. All supplied sensitive credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Database. Your credit information can only be accessed by those authorised with special access rights to our systems who are required to keep the information confidential. Unfortunately, no data transmission over the Internet can be guaranteed to be totally secure.

Do we disclose any information to outside parties?

We do not sell, trade, or otherwise transfer your Personal Information to third parties. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you. We may also release your Personal Information when we believe release is appropriate to comply with the law, enforce our Terms of Use, or protect ours or others rights, property, or safety. However, non-personal visitor information may be provided to other parties for marketing, advertising, or other uses. When you provide Personal Information and request it to be published on the Site, you consent for us to make your Personal Information public.
